Are tribute bands illegal? (unless the orignial band gets % of the $$)?

So if a band forms and plays solely covers of that bands music, isnt that copyright infringement? Don't think the original band will demand a percentage of royalties and profit? I got curious since I saw a flyer of a foo fighters tribute band. What are the rules or laws if any?
